Refund policy

OVERVIEW

We want you to be happy with your Pocket Pumps. This Returns and Refund Policy explains your rights when purchasing from our online store, including your statutory right to cancel an online purchase and your rights if goods are faulty, damaged, not as described or otherwise do not conform to the contract.

Nothing in this policy excludes, restricts or replaces any rights or remedies available to you under Irish or other applicable mandatory consumer law, including the Consumer Rights Act 2022.

1. YOUR 14-DAY RIGHT TO CANCEL AN ONLINE ORDER

If you are a consumer who purchases goods from Pocket Pumps online, you generally have the right to cancel your contract without giving any reason within 14 days from the day on which you, or a third party nominated by you other than the carrier, acquires physical possession of the goods.

If a single order contains multiple goods that are delivered separately, the 14-day cancellation period generally begins when you, or your nominated third party other than the carrier, acquires physical possession of the last of those goods.

To exercise your right to cancel, you must inform us of your decision before the cancellation period expires. You may do this by sending a clear and unequivocal statement by email to racedayrunway@outlook.com. You may also use the model cancellation form at the end of this policy, although use of that form is not compulsory.

It is sufficient for you to send your cancellation notice before the 14-day cancellation period expires.

2. RETURNING GOODS AFTER CANCELLATION

After notifying us that you are cancelling your contract, you must return the goods without undue delay and no later than 14 days after the day on which you informed us of your decision to cancel.

Please contact racedayrunway@outlook.com before sending the goods back so that we can provide the appropriate return instructions and return destination.

Unless the goods are faulty, damaged, incorrect or otherwise non-conforming, you are responsible for the direct cost of returning the goods to us. We recommend retaining proof of postage or other evidence of return.

You must take reasonable care of the goods while they are in your possession. You may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. You may be responsible for any diminished value caused by handling beyond what is necessary for that purpose.

Original packaging should be returned where reasonably possible, but the absence of original packaging does not by itself remove a statutory right to cancel. Any assessment of diminished value will be made in accordance with applicable law.

3. REFUNDS FOLLOWING A 14-DAY CANCELLATION

If you validly cancel your online purchase, we will reimburse the payments received from you for the cancelled goods, together with the cost of the least expensive standard delivery option offered by us for the relevant order.

If you chose a delivery method that cost more than our least expensive standard delivery option, we are not required to refund the additional delivery cost.

We will make the reimbursement without undue delay and, subject to applicable law, no later than 14 days after the day on which we are informed of your decision to cancel. Where you are required to return goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence that you have returned them, whichever occurs first.

Refunds will be made using the same means of payment used for the original transaction unless you expressly agree otherwise. You will not be charged a fee by us for the reimbursement. Your bank or payment provider may take additional time to show the refund in your account.

4. FAULTY, DAMAGED, INCORRECT OR NON-CONFORMING GOODS

Please inspect your order when it arrives. If an item is faulty, damaged, not as described, incorrect or otherwise does not conform to the sales contract, contact us at racedayrunway@outlook.com as soon as reasonably possible and provide your order details and a description of the issue. Photographs may be requested where reasonably helpful to assess the problem, but this will not be used to obstruct your statutory rights.

Your rights in relation to faulty or non-conforming goods are separate from the 14-day cancellation right described above.

Under Irish consumer law, where goods do not conform to the sales contract, statutory remedies may include the short-term right to terminate the contract, repair or replacement, a proportionate price reduction, or a final right to terminate the contract, depending on the circumstances and the requirements of applicable law.

Where the statutory short-term right to terminate applies, the usual time limit is 30 days beginning at the relevant time prescribed by law. This is not the same as the 14-day change-of-mind cancellation period.

Where goods are to be repaired or replaced under your statutory rights, this will be carried out free of charge, within the period required by law and without significant inconvenience to you. Where you validly terminate the contract because goods are non-conforming, the goods are returned at our expense and any refund will include amounts that applicable law requires us to reimburse.

Nothing in this policy requires you to accept store credit instead of a refund or other statutory remedy where the law entitles you to that remedy.

5. CHANGE OF MIND, FIT AND SIZING

A change of mind, including deciding that you would prefer another colour or size, is not a product fault. For online purchases, however, your statutory 14-day cancellation right generally allows you to cancel without giving a reason, subject to applicable legal exceptions.

Because footwear can show signs of wear quickly, we recommend trying Pocket Pumps on carefully and on a clean, dry indoor surface while deciding whether to keep them. This does not prevent reasonable inspection of the goods or restrict your statutory rights.

Where a product page describes sizing or fit as approximate, this does not affect your right to receive goods that conform to the description and other terms of the sales contract.

6. EXCHANGES

We do not currently operate a direct exchange service. If you would like a different size or colour, you may return the original item in accordance with this policy and place a new order for the preferred item.

This exchange procedure does not limit any right you may have to a replacement as a statutory remedy where goods are faulty or otherwise non-conforming.

7. SALE AND PROMOTIONAL ITEMS

Your statutory consumer rights apply to sale and promotional items in the same way as they apply to other goods. We do not exclude statutory cancellation rights or remedies merely because an item was purchased at a reduced or promotional price.

8. RETURN SHIPPING

For a return made solely because you have changed your mind under the statutory 14-day cancellation right, you are responsible for the direct cost of returning the goods.

Where goods are faulty or otherwise non-conforming and applicable consumer law requires Pocket Pumps to bear the return cost, we will do so. Please contact racedayrunway@outlook.com before arranging such a return so that we can provide appropriate instructions.

We are not responsible for a return parcel that is lost before reaching us where the return is being arranged by you, except to the extent that applicable law provides otherwise. We recommend obtaining proof of postage.

9. REFUND PROCESSING

Once a return is received, we will inspect it where appropriate and process any refund due in accordance with this policy and applicable law.

For statutory refunds relating to non-conforming goods, reimbursement will be made without undue delay and within the time required by applicable law, using the same means of payment used for the original purchase unless you expressly agree otherwise and without a reimbursement fee being imposed by us.

10. CANCELLING BEFORE DISPATCH

If you wish to cancel or amend an order before it has been dispatched, contact racedayrunway@outlook.com as soon as possible. We will try to accommodate the request where practicable.

Our ability to stop an order before dispatch does not affect any statutory cancellation right that applies to your online purchase.
